1.01 Minor repairs, hammering, drilling or any other related activity which creates noise or may disturb other unit residents is permitted between the hours of 9.00 a.m. to 9.30 p.m. on weekdays and 9:00 a.m. to 6.00 p.m. on Saturdays. No work is permitted on Sundays & holidays.
1.02 Major work being done in or on Suites must be restricted to the hours of 9.00 a.m. to 5.00 p.m. Monday to Friday. No work is permitted on weekends or holidays. This refers to Board approved renovations. See Section 2.01.
1.03 No owner shall create or permit the creation or continuation of any noise or nuisance which, in the opinion of the Property Manager or the Board, may or does disturb the comfort or quiet enjoyment of the units or common elements by other owners or residents.
1.04 No noise, caused by any instrument or other device, or otherwise (such as garberators), which in the opinion of the Property Manager or the Boards may disturb the comfort or quiet enjoyment of the owners or residents, shall be permitted.
1.05 In order to reduce or eliminate the penetration of sound from one unit to another, in circumstances where the Board or Management has received, in writing, complaint(s) from another or other resident(s) of the building, which complaint(s) the Board, in its sole discretion, acting reasonably, determines that the complaint(s) is/are justified, the Board may require the unit owner in whose unit the original broadloom or cushioned flooring has been replaced with hardwood, ceramic tile, marble or similar type of floor covering, to arrange, within thirty (30) days of receipt of notice from the Board, to cover the affected area(s) with broadloom and suitable underpadding. The unit owner whose existing floor covering(s) is/are the source of the complaint, shall comply with the notice.
2.00 COMMON ELEMENTS AND UNITS
(a) GENERAL
2.01 Owners/residents must not make any structural changes or alterations in or to any unit without the prior written consent of the Board of Directors. (See Condominium Declaration, Part 5, Section 17, Paragraph c.) 'SUITE ALTERATION' Forms are available at the Property Management Office for these requests. Refer to section 10.04.
2.02 All access controls issued by the Boards through the Property Management Office, such as key fobs, garage access cards and photo-identicards, must be returned on vacating a unit. A new residing owner/resident will receive common element key fobs and garage access cards from the Property Management Office only.
2.03 No articles or doormats shall be placed at individual doorways in the hallways or affixed permanently. No holes of any kind for the purpose of installing hooks, door bells, doors knockers, etc., shall be put in suite doors without the permission of the Board.
2.04 No rollerblading, skateboarding, etc. will be permitted anywhere (buildings or grounds) in the complex.
2.05 No resident shall permit an infestation of pests, insects, vermin or rodents to exist at any time in his/her unit or adjacent common elements. Residents shall immediately report to the Property Management Office any incidence of pests, insects, vermin or rodents. Upon receipt of notice in writing, each unit holder shall permit entry to his/her unit for the purpose of pest control operations including spraying operations if required. Each unit owner shall prepare the unit in the manner prescribed in the aforesaid notice, and shall permit and facilitate entry into the unit by any authorized pest control personnel, and shall co-operate in order to carry out the full extent of this rule.
2.06 The water closets (toilets) and other water apparatus shall not be used for purposes other than those for which they are constructed and no sweepings, food, bones, garbage, rubbish, rags, ashes or other substances shall be thrown therein. Any damage resulting from misuse or from unusual or unreasonable use shall be borne by the owner who has, or whose family, guests, visitors, servants, tenants or agents, have caused such damage.
2.07 No sign, advertisement or notice shall be inscribed, painted, affixed or placed on any part of the inside or outside of the buildings or common elements whatsoever without the prior written consent of the Property Manager or the Board.
2.08 No canvassing whatsoever will be allowed without written consent from the Board of Directors. Political canvassing may be permitted with proper notice.
2.09 No flyers/advertising, of any sort may be left at suite doors at any time.
2.10 Water shall not be left running unless in actual use. Electric lights must be turned off when not required.
2.11 The owner of a unit shall not place, leave, or permit to be placed or left, in or upon the common elements (including those of which he has the exclusive use) any debris, refuse or garbage, except on such days or times as designated by the Boards or the Property Manager; nor shall any owner place or deposit any such garbage or debris except in those areas designated by the Corporation or the Property Manager as a central garbage depository.
2.12 Garberators (waste disposal units) are not permitted to be installed in suites.
2.13 No auction or garage sale shall be held in any of the units or the common elements unless it is a sponsored event by the Corporations.
2.14 Save as otherwise provided or contemplated in the Declaration of the Corporation, the sidewalks, lobby, passageways, walkways and driveways used in common by the owners and residents shall not be obstructed by the owners, residents or their guests, or used by them for any purpose other than for entrance and exit to and from their respective units and/or the common elements.
2.15 No television antennae, aerial, satellite dish, tower or similar structure and appurtenances thereto shall be erected on or fastened to any unit, except in connection with a common television cable system supplying service to the entire building. The Corporation will remove all television antennae, aerial, satellite dish, tower or similar structure if not done so after 72 hours notice has been sent by the Property Management Office.
2.16 No one shall harm, mutilate, destroy, alter or litter any of the landscaping work on the property, including grass, trees, shrubs, hedges, flowers or flower beds, nor shall anyone uproot existing plants, hedges, shrubs or trees, nor plant new shrubs, hedges or trees anywhere upon the common elements, without the prior written approval of the Board.
2.17 No Open Houses or other events open to the public to facilitate the sale or rent of a unit will be permitted.
2.18 Unit owners, residents, their families, guests, visitors, servants or persons having business with them, shall not congregate in the lobby, hallways, passageways, walkways, driveways, or other parts of the common elements or use these areas for any other purpose but to enter or exit from their respective units.
2.19 There will be no "Trick or Treating" at Halloween allowed in any of the buildings.
2.20 No "Fund Raising" of any sort will be permitted in the common areas of the complex.
2.21 The Board of Directors requires from each owner a void cheque to facilitate the monthly Common Elements Expense payments. A $50.00 fee will be charged for insufficient funds incurred for any reason.
(b) BALCONIES - Exclusive Use - Common Element
2.22 No feeding of birds or any other animals is permitted from the units or balconies.
2.23 No awnings or shades shall be erected over and outside of the windows or balconies. No carpeting or covering of any kind shall be glued or affixed in any way to balconies without written permission from the Board of Directors. Carpets must be rolled up for the winter months.
2.24 Nothing shall be placed on the outside of window sills or projections, nor upon any balcony railings, without the prior written consent of the Board. (i.e. flags, thermometers, etc.).
2.25 Nothing shall be thrown out of windows or doors or from balconies of the building. (e.g. cigarette butts, food, cans, etc.)
2.26 No mops, brooms, dusters, rugs or bedding shall be shaken or beaten from a window or door, nor from any portion of the common elements, including those parts of the common elements over which the owner has exclusive use. (e.g. a balcony).
2.27 Only flowers, plants and seasonal furniture shall be allowed on balconies. No hanging or drying of clothes shall be allowed on balconies, and balconies shall not be used for storage purposes.
2.28 No drilling of holes will be permitted in ceilings, walls or floors of balconies for the purpose of hanging baskets, decorations or seasonal lights. Planters that hang on a rack on the inside of the balcony railings will be permitted.
3.00 FIRE PREVENTION
3.01 No owner shall do, or permit anything to be done in his/her unit or bring or keep anything therein which will in any way increase the risk of fire or the rate of fire insurance premiums on any building, or on property kept therein, or obstruct or interfere with the rights of the owners, or in any way injure or annoy them, or conflict with the regulations of the relevant fire department, or with any insurance policy carried by the Corporation or conflict with any of the rules and ordinances of the local board of health, or with any municipal bylaw or any provincial or federal statute or regulation.
3.02 Smoking is not permitted in any indoor common areas including elevators, halls, stairwells, lobbies and underground garages. There is also no smoking in the outdoor pool area. Smoking is permitted in outdoor BBQ area only.
3.03 No barbecuing or any kind of cooking is permitted on balconies.
3.04 Owners shall not overload existing electrical circuits and plumbing facilities in their units or permit such overloading.
3.05 No stores of batteries or any combustible or offensive goods, provisions or materials shall be kept in the units or common elements, without the prior written consent of the Board.
3.06 The use of natural Christmas trees is prohibited because of the fire hazard and littering potential.
3.07 Automatic door closer on the suite door must be operational at all times and may NOT be disconnected, according to the Fire Code.
4.00 PARTY ROOM
4.01 Any resident owner or resident of a dwelling unit in this condominium wishing to reserve the use of the Party Room shall comply with the rules established by the Recreation Committee from time to time. See Recreation Rules and Regulations for details.
5.00 KEYS
5.01 No owner may add to, change or re-key the lock or locks of a unit entry door without forthwith providing to the Superintendent or the Property Manager a key to the new or re-keyed lock or locks for use in the case of an emergency.
6.00 OWNERS/RESIDENTS INFORMATION FORM
6.01(a) Prior to moving into his/her unit and concurrent with the booking of the elevator for such move, an owner shall register all necessary information at the Property Management Office. Only registered residents will be issued key fobs to a maximum of 6 (based on the number of sleeping rooms noted on the original architectural drawings - such as 1 Bedroom Units will receive a maximum of 2 fobs, 2 Bedroom Units will receive a maximum of 4 fobs, 3 Bedroom Units will receive a maximum of 6 fobs). This should be updated at the Property Management Office as changes occur.
6.01(b) Lost fobs are subject to a replacement fee as determined by the Boards of Directors from time to time.
6.02 Any change in the residents of a unit shall be reported immediately to the Property Management Office.
6.03(a) Any lease of a residential unit must be for a term of at least one year and a tenant with a one year lease or longer may not sublet or allow a third party to occupy the unit for less than one year.
(b) Prior to entering into a lease of his/her unit, an owner shall provide the Property Management Office with a completed copy of the Lease Agreement and 'Form 5' as per the Condominium Act, 1998, providing details of the owner's new address and such additional information as the Boards of Directors may from time to time require. The owner shall also provide preliminary information as to the tenant.
6.04 Within twenty days of ceasing to rent his/her unit or within twenty days of being advised that his/her tenant has vacated or abandoned the unit, as the case may be, the owner shall notify the Property Management Office or the Boards that the unit is no longer rented.
6.05 Every new owner/resident shall provide the Property Management Office with complete resident's information prior to occupancy.
7.00 PETS
7.01 Effective June 30th, 1988, no owner or resident of M.T.C.C. 634, 726 and 741 shall keep or permit to be kept in a unit, a new dog, and for the purposes of this rule, 'new dog' means a dog not owned by a unit owner or resident prior to June 30th, 1988 and kept in a unit of M.T.C.C. 634, 726 or 741 prior to that date. This rule does not apply to those owners who have a certified need for a seeing eye dog or a dog for the hearing impaired.
Therefore, only those residents/owners who lived here with a dog prior to June 30th, 1988, may still have a dog residing on the premises and it may not be replaced.
7.02 to 7.17 (rules governing existing pets) inclusive are kept in the Property Management Office with the By-Laws of the Corporations.
7.18 Visitors and guests are not allowed to bring pets into the complex or building.
8.00 PARKING
(EXCLUSIVE USE - COMMON ELEMENT)
8.01 Any owner parking a vehicle upon any part of the common elements must first obtain a parking sticker (decal) from the Property Management Office. A sticker will only be issued upon the completion of a form containing the following information: make, model, year, colour, licence plate number, vehicle ownership, name and address of driver(s) and any other related information required by the Board from time to time. The sticker (decal) must be affixed to the vehicle described on the information form, on the lower left (driver's) side of the windshield.
8.02 Parking spaces may be leased only by the Declarant, the Corporation, either of the adjacent Condominium Corporations, or any owner or tenant of a dwelling unit in any of the three Condominium Corporations. (Note that this provision is contained in the Declaration and cannot be restricted further). The terms of such a lease of any such parking spaces must not extend beyond the tenancy of the dwelling unit. Any resident leasing a parking space must obtain a parking sticker (decal) as set out in 8.01.
8.03 Every owner/resident using parking space shall re-attend the Property Management Office as required from time to time by the Board, to update their information forms and to obtain sticker/decal renewals. Any change to the information provided on the form must be reported immediately to the Property Management Office.
8.04 Once the sticker or decal has been affixed to the vehicle, the owner may park in the following areas: parking spaces designated to their respective units in the registered Declaration or registered on title in the Land Titles Office in the name of the person parking the vehicle, or in parking spaces leased by them.
8.05 Visitors vehicles must park in the parking spaces designated visitors. Residents shall not park in Visitor areas for extended periods of time.
8.06 Visitor's vehicles parked in the visitor's parking spaces for over three hours and not displaying a 'GUEST AUTHORIZATION TO PARK' form, may be tagged and/or towed away, at the owner's expense. All owners/residents may obtain "GUEST AUTHORIZATION TO PARK' forms from the Guard House or the Property Management Office. These forms may only be used by the bona fide visitors or guests of the owner/resident applying for them. Applicants must supply the information required.
8.07 'GUEST AUTHORIZATION TO PARK' forms are valid only for the vehicle, times and dates shown and registered in the Guard House or the Property Management Office. Guests may only park in the spots designated to them by the Guard House or Property Manager. The form must be placed in a fully visible position on the left hand side of the dashboard.
8.08 'GUEST AUTHORIZATION TO PARK' forms are not valid for a period longer than 72 hours unless specifically authorized through the Property Management Office.
8.09 'GUEST AUTHORIZATION TO PARK' forms are not valid for use on vehicles owned or driven by residents of M.T.C.C. 634, 726 or 741 unless they are specifically authorized by the Property Manager.
8.10 Parking is prohibited in all visitor parking spaces between the hours of 2:00 a.m. and 7:00 a.m., except as provided specifically on the face of a 'GUEST AUTHORIZATION TO PARK' form.
8.11 Indoor or outdoor parking spaces may only be used for cars, station wagons, small vans, pickup trucks, jeeps, 4x4 trucks and motorcycles, unless otherwise authorized. They must be in good repair, containing no exposed materials, tools or equipment and in good running condition. Any damage done to the common elements by the vehicles is the responsibility of the owner. The vehicle must fit within the parking space as defined by the lines and may not intrude into the common elements.
8.12 All vehicles parked in designated parking spaces and not bearing a sticker/decal or a 'GUEST AUTHORIZATION TO PARK' form may be tagged and/or towed away at the owner's expense. If a vehicle other than the registered vehicle is to be parked temporarily underground, a permit must be obtained from the Property Management Office.
8.13 No motor vehicle may park on the surface roadways within the property. These roadways are designated fire routes. Any vehicle parked on these roadways may be tagged and/or towed away at the owner's expense.
8.14 Parked vehicles must not encroach on driveways or adjacent parking spaces.
8.15 Motor vehicles must not exceed 10 km per hour on the surface roadways, driveways and ramps of the indoor parking areas.
8.16 All motor vehicles in motion in the indoor parking areas must have their headlights on and must not sound horns.
8.17 No servicing or repairs shall be made to any vehicle on the common elements or in a parking space.
8.18 No trailer, camper, recreational vehicle, boat, snowmobile, tires, combustible materials, machinery or equipment of any kind shall be parked or left on any part of the common elements, nor shall any motor vehicle be parked on any spot of the common elements other than a designated parking spot.
8.19 No motor vehicle or any other kind of vehicle shall be driven on any part of the common elements other than on a surface roadway, driveway or ramp.
8.20 Each parking space shall be used and occupied only for the parking of motor vehicles, save for the storage of a bundle buggy against a wall in a neat and tidy manner.
8.21 The user of each parking space shall maintain the space in a clean and tidy condition including the elimination of oil and grease spills and, where such is not done, the Corporation may have the parking space cleaned/sealed and may charge the cost of such cleaning/sealing to the unit owner and collect any amounts owing as may be provided in the Condominium Act or by any other lawful means.
8.22 No person shall park or use a motor vehicle in contravention of these rules. If such should occur, the person is liable to be fined or have his/her vehicle towed away from the property in accordance with city bylaws. In such an event neither the Corporations, its Directors, employees or agents shall be liable whatsoever for any damages, costs or expenses howsoever caused to such motor vehicle or to its owner.
8.23 No person shall place, leave, park or permit to be placed, left or parked on the common elements any motor vehicle which, in the opinion of the Property Manager, or as directed by the Boards, may pose a security or safety risk, either caused by its length of unattended stay, its physical condition or appearance or its potential damage to the property. On 12 hours notice from the Property Manager, the owner of the vehicle shall be required to either remove or attend to the vehicle as directed by the Property Manager, in default of which the vehicle shall be removed from the property at the expense of the owner.
8.24 Anyone who does not remove vehicles from the underground garage during scheduled maintenance/cleaning may be subject to a special cleaning fee.
8.25 All vehicles must obey stop signs as posted.
8.26 All residents entering the complex should use the "Residents" gate and not the "Visitors" gate.
8.27 Bicycles may not be taken on elevators, through the main floor lobby of the building, up stairwells, or ridden on the walkways. Bicycles may not be stored in parking spaces but must be stored in bicycle racks as designated by the Property Manager. Motorcycles are restricted to authorized parking areas and must comply with all other parking rules/regulations.
9.00 ELEVATORS
9.01 Smoking is prohibited in the elevators, as in other common elements. Owners must ensure that their guests abide by this rule.
9.02 In the event of an emergency, push the emergency button on the panel. The alarm will signal that there is an emergency and the necessary action will be taken. Press the "Aiphone" button or pick up the phone to communicate with the Gatehouse.
9.03 Arrangements for using the service elevator when moving in or out or receiving deliveries must be made in advance with the Property Management Office. Any damage incurred while elevator is used during move/delivery will be charged to the suite owner. When moving out all common element key fobs and garage access cards must be returned to the Property Management Office. Only the service elevator is to be used for moving/delivery.
9.04 Moves and/or deliveries are restricted to Mondays to Saturdays, commencing at 9.00 a.m. and concluding at 5.00 p.m. No moving is permitted on Sundays or holidays. Moves and/or deliveries are not permitted through the lobbies.
9.05 Use the 'DOOR OPEN' button on the elevator panel to hold the door open when necessary. Other methods such as placing objects to jam the door may damage the elevator mechanism.
9.06 The elevators must not be used during a fire alarm. See fire alarm instructions on each floor.
10.00 WASTE DISPOSAL
10.01 HOURS OF USE - 7:00 a.m. to 10:00 p.m. only.
10.02 Each floor has a disposal room with a chute connected to the garbage compactor on the ground floor. Garbage is to be securely wrapped and placed in the disposal chute. Be sure to push the garbage clear of the chute doors to ensure it drops down and does not block the chute.
10.03 Glass bottles and newspapers etc., must be taken down to the recycling bins. No garbage or litter may be left on the disposal room floor.
10.04 All construction or suite refurbishing debris must be removed from the property on a daily basis. It must not be deposited into the Corporations' garbage bins or down the garbage chute.
10.05 Items too large for the chute such as boxes must be broken down and taken to the ground floor Garbage Disposal Room or designated area. If the room is locked, please make arrangements with the superintendent on duty for access to this area.
10.06 No flammable materials and/or liquids may be placed in the chute.
10.07 Nothing may be placed in the chute, which may result in a blockage or damage of such chute or compactor.
11.00 GENERAL (LIABILITY)
11.01 Any and all losses, costs or damages incurred by the Corporation by reason of a breach of any provision in the Declaration, Bylaws and/or Rules and Regulations of the Corporation in force from time to time, by any Owner/Tenant/Resident shall be borne and/or paid for by such Owner/Tenant/Resident and may be recovered by the Corporation against such Owner/Tenant/Resident as may be provided in the Condominium Act or in any other lawful manner.
12.00 GUEST SUITES
12.01 There are two guest suites available in both Vista and Trillium for the convenience and use of residents' guests.
12.02 The suites are located on the ground level. The guests may use the recreational facilities, which include an indoor and outdoor swimming pool, whirlpool, ladies' and men's sauna and tennis, squash and racquetball courts. However, the guests must be accompanied by the sponsoring owner or tenant.
12.03 Please be aware that a guest is subject to all of the Corporation's rules and regulations.
12.04 Guest suites are available on a first-come basis.
12.05 The fee for service/cleaning charges is $50.00 per night for each suite with a minimum refundable damage deposit of $100.00.
12.06 The maximum stay for a guest is 7 nights unless approved by the Property Manager or the Board.
12.07 Residents may book the suite(s) via telephone or in person. Full payment by cheque is required from the resident within 48 hours of making the booking and completing and signing the necessary forms. Cheques should be made payable to M.T.C.C. 741 or 726, as appropriate.
12.08 The guest suite key/fob should be picked up from the Property Management Office (when open) or the gatehouse by the resident making the booking. Upon leaving, the resident is required to lock the guest suite door and leave the key/fob with the Property Management Office or gatehouse.
12.09 There is a $100.00 replacement charge for a lost key/fob, which is the responsibility of the resident.
12.10 Check in time is 2:00 p.m. and check out time is 11:00 a.m.
12.11 Daily cleaning of the suite includes the changing of sheets and towels.
13.00 CAR WASH
13.01 There is a car wash in Skypark, Vista and Trillium for the restricted use of residents only. Only one car may be washed at a time. Time is restricted to 30 minutes (Washing and drying). Vehicles must be turned off when washing or waiting.
